The legal gender change process in India has 3 main steps
Affidavit
Prepare a gender change affidavit. In which your new and old name will also be written. In which it will also be written that you have changed your gender.
Newspaper
After preparing the affidavit, publish an advertisement for gender change in the local newspaper of your state.
Gazette
Prepare a file with newspaper, affidavit, GID certificate and other documents and apply for gender change in the gazette.
What is the gender change process and how to do it?
Legal gender change process
The gender change process is done through legal process and medical process, gender change process is legal in India. But after changing the gender physically, it is also necessary to change the gender legally. Which takes a lot of time for the person. Because in this, the name and gender of the person is changed from all the documents and identity certificates. And proof of gender change is asked for changing the name and gender in all the documents.
In all these circumstances, the legal gender change process is the only solution. This process is done through gazette notification. In which the information about gender change is published in the gazette notification. After which that gazette gender change certificate will work as proof of gender change in all your documents.
There are 2 Processes to Change Gender
There are different reasons for changing a name and hence the types of name changes are also different.
Medical Gender Change
This is a medical procedure in which a person changes his gender according to his wish. This procedure involves several stages. First of all, through hormone therapy, the person is given hormones for the opposite gender. These cause changes in the body such as voice, increasing or decreasing hair on the body, and body shape. The second is surgery in which breast removal, genital reconstruction and facial changes are done through surgery.
Legal Gender Change
When a person changes his gender physically, then the person has to change his name and gender in all his documents and identity certificates as well. Due to which your identity will be based on your new name and gender. For this, first of all you have to publish the name and gender change publication in the gazette. After which that gazette is used as proof of gender change to change gender in all documents as well.
There are 2 Types of Gender Change
There are different reasons for changing a name and hence the types of name changes are also different.
Documents Required for Gazette Gender Change Process
All the necessary documents required for the gender change in gazette notification
AFFIDAVIT
Affidavit of gender change issued by the applicant, containing the new and old name and address.
NEWSPAPER
The newspaper in which the name and gender change was published. Witness form containing signatures of the applicant and two witnesses and the material to be published in the gazette.
CD ( DIGITAL FORMAT )
CD containing a soft copy of the material containing the old and new name of the applicant, used for printing in the gazette.
PHOTOGRAPH'S
Two passport size photographs of the applicant
ADDRESS & ID
Photocopy of a valid identity card with address. (Aadhar card, passport etc.) Fee receipt issued from the Bharatkosh website for the process.
GID Certificate
This certification is given by any doctor when a person undergoes gender change.
Update Document with
Gazette Notification for Gender Change
When the publication of your gender change will be published in the gazette notification. After that this gazette will be used to change the gender in the Aadhar card. For which the person has to go to his nearest Aadhar Seva Kendra and fill the Aadhar update form. Submit photocopies of some important documents and photocopies of the gazette gender change certificate which will be proof of the person’s gender change, on the basis of which the gender will be changed in the Aadhar card. After filling the form, pay the fee, after that you will get a slip which will contain your UTR number. Through which you can track the process of gender change of your Aadhar card. It may take at least 7 days for the gender to be updated in the Aadhar card.
After changing the gender in the Aadhaar card through the gazette notification, you will also have to change the gender in the PAN card. For this, you can change the gender in the PAN card through any medium online or offline. Visit the official website of the Income Tax Department (UTIITSL.) and submit the form to update the gender in your PAN card. In the form, you will have to submit the necessary documents like Gazette Name Change Certificate or Aadhaar Card. Keep in mind that only the new Aadhaar card updated with the Gazette Gender Change Certificate will have to be submitted. Your PAN card will be updated only from your updated Aadhaar. Wait for a few days after submitting the form. After your documents are verified, the new e-PAN card will be sent to you by post within 7 days. And after a month the physical PAN card will also be sent.
After changing the gender in Aadhaar card and PAN card with the help of Gazette, take an appointment at your nearest passport seva kendra to change the gender in passport and inform the details related to gender change. On the given date, take your Aadhaar card and Gazette updated PAN card, newspaper cutting and Gazette gender change certificate with you. There you will be asked to fill a form in which you have to submit your current passport and also Gazette gender change certificate, Aadhaar card, PAN and other documents. This process will take a few days. After verification of all your documents, the new passport will be issued by the passport office and sent by post to your given address within a month.
The name and gender on the driving license can be changed only after the Aadhaar card is updated. To change the name and gender on the driving license, visit the transport department website (parivahan.gov.in) and click on Driving License Name Change Service. Submit your driving license details and Aadhaar card or for offline process, visit your nearest RTO office and talk to an officer and fill the name and gender change form in driving license. Submit your updated Aadhaar card, gazetted name gender change certificate, newspaper cuttings along with the form. Based on these, the name and gender will also be changed in your driving license. It will take a few days to get updated and get a new driving license.
